Job description

Introduction

The Office of the Department Prosecutor handles prosecution in administrative and regulatory hearings at the State Office of Administrative Hearings. Reporting directly to the Director, this role focuses on investigating misconduct allegations against both sworn and civilian employees per State laws, regulations, and departmental policies. The incumbent reviews police misconduct investigations, presents evidence to the Administrative Charging Committee (ACC), and prepares disposition reports and charging documents while coordinating closely with law enforcement and ACC members to ensure cases are properly handled and laws enforced. Confidentiality, impartiality, and professionalism are critical.

Primary Responsibilities

  • Lead administrative investigations into employee misconduct allegations involving civilian personnel, including evidence gathering, interviewing witnesses, preparing charging documents, and drafting settlement agreements.
  • Thoroughly review police misconduct investigations to ensure completeness and accuracy before forwarding to the ACC.
  • Coordinate follow-up activities with investigators, such as additional research, evidence collection, and witness interviews.
  • Evaluate evidence quality and readiness for administrative prosecution; draft charging documents and take part in administrative hearings.
  • Serve as liaison with the ACC, managing case files, evidence, findings, and recommendations to guarantee proper case proceedings and law enforcement.
  • Ensure all investigative cases adhere to State and departmental timelines.
  • Schedule and support prosecutors preparing for trial board proceedings.
  • Represent the Department in hearings including Grievance, ASED Emergency Suspension, and Civilian Disciplinary matters, as assigned.

Minimum Qualifications

  • High school diploma or equivalent.
  • At least five years in administrative or professional staff roles.
  • Substitutions allowed: 30 college credits per year (up to four years) in place of experience; or a Bachelor's degree plus one year relevant experience; or a Master's degree in lieu of required experience; or military service experience with relevant staff duties counted year-for-year.

Preferred Qualifications

  • Experience conducting administrative investigations of employee misconduct.
  • Experience reviewing investigations and preparing Disposition Reports and charging documents.

Licenses and Requirements

  • Must possess a valid Maryland motor vehicle operator's license if duties include driving.
  • Candidates must pass a full criminal background check and polygraph examination before appointment; criminal convictions may disqualify applicants.

Selection and Examination

Only applicants meeting minimum qualifications will be considered. Selection is based on rating education, training, and experience. Applicants might be required to complete supplements, physical exams, interviews, background checks, polygraph tests, and substance abuse screenings. A one-year eligibility list will be created categorizing candidates as Best Qualified, Better Qualified, or Qualified.
