Position Overview
The Harris County Public Defender's Office is dedicated to delivering client-focused, high-quality defense representation for individuals unable to afford legal counsel. The Wrongful Convictions Division specializes in identifying, investigating, and litigating cases involving actual innocence and wrongful convictions through post-conviction advocacy.
Key Responsibilities
- Evaluate claims of actual innocence and wrongful convictions critically.
- Lead thorough factual and legal investigations in post-conviction matters.
- Conduct detailed research on complex constitutional, procedural, forensic, and evidentiary issues.
- Prepare various legal documents, including writ applications for habeas corpus, Chapter 64 motions concerning forensic DNA testing, appellate briefs, and memoranda.
- Provide representation in post-conviction hearings, proceedings, and associated litigation.
- Locate and assess records, evidence, witness testimonies, forensic data, and other materials pertinent to innocence claims.
- Work collaboratively with investigators, forensic experts, and support personnel to develop case strategies and theories.
- Maintain consistent and clear communication with clients, their families, experts, and all relevant stakeholders.
- Stay updated on legal developments relating to post-conviction law and practices.
- Ensure detailed case documentation and record-keeping in line with office protocols.
- Undertake additional tasks as required by the office.
Preferred Qualifications
- Prior experience managing post-conviction writ litigation cases.
- Proficiency in litigating Chapter 64 motions connected to forensic DNA testing.
- Knowledge of forensic science, DNA evidence, and wrongful conviction issues.
- Competence in conducting complex factual investigations.
- Experience drafting appellate and post-conviction legal pleadings.
